New York City, New York Building Codes

Overview

New York City adopts its own code instead of following the state code. Their local laws are very confusing. In general, the code is based on the 2003 IBC with amendments bringing it in line with the 2009 IBC. See the NYC Admin. Code. Chapter 7. Sections 28-701.1-2. (excerpts provided below. Note that NYC Admin Code Ch. 7 contains its own chapters, which is confusing. The city publishes a page with code information. They call the current codes the 2014 Construction Codes. Earlier codes include the 2008 Construction Codes, the 1968 Code, and the 1938 code.

Article 701:Enactment and Update of the New York City Building Code

§ 28-701.1 Update.

No later than the third year after the effective date of the section 701.1 and every third year thereafter, the commissioner shall submit to the city council proposed amendments that he or she determines should be made to this code to bring it up to date with the latest edition of the International Building Code or otherwise modify the provisions thereof. In addition, prior to the submission of such proposal to the city council, such proposal shall be submitted to an advisory committee established by the commissioner pursuant to this title for review and comment.

§ 28-701.2 Enactment of the New York City Building Code.

The New York City Building Code based on the 2003 edition of the International Building Code published by the international Code Council, with changes that reflect the unique character of the city and amendments that bring it up to date with the 2009 edition of such International Building Code, is hereby adopted to read as follows:

Chapter 1: Administration

Section BC 101: General

101.1 Title.

This code shall be known and may be cited as the "New York City Building Code," "NYCBC" or "BC". All section numbers in this code shall be deemed to be preceded by the designation "BC".

NYC adopts its own code based on both the 2003 IBC and 2009 IBC. We see no adoption of a specific residential code for one and two-family dwellings.

Appendix M lists a few special requirements for one and two-family dwellings.

Commercial Building Code

New York City adopted the 2009 IBC, locally. Note that adoptions usually come with amendments. So, it is important to review those amendments in addition to the unamended model code.
